GENERAL TERMS AND CONDITIONS
FOR ALL AUCTION SALES
By bidding at this
auction, prospective bidders agree to be bound by the following Terms and
Conditions.
REGISTRATION
All bidders must register their name, permanent street address and phone
number prior to the auction. Internet bidders are required to register and
establish an account with Aaron Posnik and Co., Inc. This may be accomplished
by any of the following: Certified or Bank Check, Personal/Company Check accompanied by a Letter of Guarantee click here for sample letter

. Internet bidders must establish an account at least 48 hours before
auction begins.
DEPOSIT
We require a 25% deposit of
your expected high bids from all Live Webcast Bidders upon registration. This
can be in the form of Certified or Bank Check, Wire Transfer of Funds click here for wire transfer instructions
. Personal or Company check accepted only if
accompanied by a Bank letter of Guarantee click here for sample letter. All
onsite bidders will be required to give a deposit after each successful bid.
Cash is also acceptable onsite.
TERMS OF SALE
The highest bidder for each lot shall be the buyer. If a dispute arises
as to any bidding, or between two or more bidders, the item in dispute will be
immediately put up again for resale, or the dispute may be resolved by the
auctioneer in his sole discretion and his decision will be final.
BUYER’S PREMIUM
Aaron Posnik and Co., Inc. may charge and retain a non-negotiable Buyer's Premium on each item purchased by the successful bidders in addition to the purchase price. If a Buyer's Premium is to be charged it will be so stated in the specific terms of that sale.
TAXES
Where required by law, all bidders are subject to State Sales Tax
unless the bidder has filled out a Sales Tax Exemption Certificate and has
supplied Aaron Posnik and Co., Inc with a copy of their certificate.
HOW DO I BID
INTERNET BIDDING through our Provider is offered as a service to our
customers, and bidders shall not hold the auctioneer, his client or his staff responsible
for any failure due to the loss of the applet supplied to Aaron Posnik and Co.,
Inc by the Provider.
ABSENTEE BIDDING: Absentee bids left through our Provider are
automatically bid electronically by the Provider. These electronic bids often
compete against absentee bids left directly with Aaron Posnik and Co., Inc.’s
staff by prospective bidders who are not participating in the Internet
component of the auction. These bids are executed competitively by a member of
Aaron Posnik and Co., Inc.’s staff at the time of the live Auction, and are
often in direct competition with Internet bids. In the event that there is a
tie absentee bid, the earliest recorded bid shall be the winner.
PAYMENT
Only cash (onsite), a Company/Personal check with a Bank Letter of Guarantee, a Letter of Credit, or Bank Wire Transfer, are acceptable methods of payment. Successful Live Webcast bidders and Absentee Bidders are required to pay for their purchases immediately upon receipt of an electronic, or paper invoice.
If Aaron Posnik and Co., Inc has not received full payment according to the “Terms” above, the purchaser authorizes Aaron Posnik and Co., Inc to retain the deposit and resell the purchases.
The lots shall be taken away and paid for at the buyers risk and expense within the time announced by Aaron Posnik and Co., Inc. Neither the Auctioneer, nor the owner being responsible for the correct description, genuineness, authenticity or defect in any lot, and making no warranty in connection therewith. No sale will be set aside nor allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted. No credits will be given for damaged articles, as all goods are exposed for public inspection, and sold “AS IS AND WITHOUT WARRANTEE” and without recourse.
AFTER THE AUCTION
Aaron Posnik and Co., Inc will invoice all successful bidders immediately after the close of the auction. Successful bidders are expected to pay for their purchases immediately.
SHIPPING
It is the buyer’s responsibility to arrange packing and shipping of any and all purchases. It is the responsibility of the buyer to pay for all shipping and handling charges. Aaron Posnik and Co., Inc. will need to see a paid invoice before removal of any and all purchases.
REMOVAL
All purchases must be completely removed by the date posted for each sale. The removal deadline will be posted for each sale under the sales “Terms and Conditions”.
REMOVAL HOURS AND
DATES
No items may be removed until the auction is complete, and full payment is made.
Regular removal hours are from 8:30 a.m. – 4:30 p.m.
Monday through Friday. Specific dates are set for each sale. These dates and
times are strictly enforced.
